I woke up this morning thinking of a way to make it easier to get ORVs on the street in Michigan. as of now the law says we can use a ATV on the roads with a handicap placard or a Doctors slip , so with that said I want to propose a new idea to the ORV board.

I would like to see a Handicap ORV sticker avalable to us ORV users that would do away with the Doctors slips and gray areas withen the law. if you had say a Blue ORV sticker then it would let the Cops know the vehicle & operator is legal and to not bother them for the tag. I think many of you who do not use the current law would fine vast new areas open to you with the ability to ride free of harrasment by the law.

the law requires you to use your quad in a safe manor and to not interfere with traffic, so its not a question of how to operate.

heres some history so you can know how the law reads.


Off Road Vehicle Certification of ORV Privileges for Persons with a Disability
Persons that meet the following criteria are permitted to operate licensed ATVs/ORVs less than 50" wide on forest roads that are open to public vehicular travel on state lands (including those not posted open to ORVs). Privileges do not extend to cross-country travel nor to areas, trails and roads specifically posted CLOSED to vehicle or ORV use, nor to the operation of an ORV within state game, wildlife, or research areas, federal forest lands, state parks, state recreation areas or Michigan trailways:
  • Those persons issued a valid temporary or permanent handicapper parking permit issued by the Secretary of State Office.
  • Those persons holding Permits to Hunt from a Standing Vehicle.
  • Those persons with a physicians certification for the following disabilities:
    • Loss of 1 or both legs or feet;
    • Inability to walk more than 200 feet without having to stop and rest;
    • Inability to walk without prolonged use of wheelchair, walker, crutches, braces or other devices to aide in mobility;
    • Lung disease from which the person's expiratory volume for 1 second is less than 1 liter when measured by spirometry;
    • Lung disease from which the person's arterial oxygen is less than 60 mm/hg of room air at rest;
    • Cardiovascular disease from which the person measures between 3 and 4 on the New York heart classification scale/
    • Cardiovascular disease from which a marked limitation of physical activity causes fatigue, palpitation, dyspnea or anginal pain;
    • Other disease or disorder including but not limited to severe arthritis or neurological-orthopedic impairment that creates a severe mobility limitation.

  • Persons with obvious severe disabilities (i.e., paraplegics, quadriplegic).
Operation of the ORV is subject to licensing and all other requirements and restrictions, and shall only be at a speed and in a manner which does not degrade the environment. These privileges may extend to one companion of the disabled person serving as operator or passenger of the disabled person's ORV, if the ORV is designed for passenger use.

Hopefully I will never have to use that provision.

With that being said, I think it's a great idea. As long as it's not abused like the handicapped parking permits are.

Edit: Take this line out

i am disabled for nerve damage im here to tell you that that needs to be in there because walking for some people causes extreme pain (as with me the way it feels like most times is walking barefoot on the white jagged rocks they put on railroad tracks) i know some people abuse the ruls but i use the rule for hunting and fishing...

Then add to the line or law that proof needs to be given.

It is for your own good. Look at all those people that are not handicapped at all and use thier relatives mirror tag to steal the parking spots or just downright got a fake doctor's note.

I know theres plenty of abuses with the Placards when it comes to parking, many spouses and such using the others placard. I think the abuse would minimal at best since not everyone would buy a Handicap ORV sticker. just remember if people were to have them they would be able to use Rhino type vehilces as well as quads, the idea is get people off the couch and into a sport, if we can push the issue we might have a chance of getting the state to issue something in favor of it.

When I had my heart condition I wasnt allowed to walk long distances, so that is a real reason for being handicapped.

They already made it possible for golf carts about 2 years ago. You have to be on a street rated for 25mph or less. The"low-speed" vehicle has to be equiped with proper lights and signals, and ALL motor vehicles must have proof of insurance, then you can qualify for a low-speed vehicle registration. Quads are not low-speed, so don't qualify for that one.

Gem cars and ELECTRIC golf carts fall under the guise of LSV(Low speed vehicles) as per the D.O.T. they have less restriction then a Moped as in no lisence required. the stipulation is they have to have a windsheild and roof with seat belts. I have read the reg, its in the D.O.Ts website

the Gem cars are goverened down to under 25 mph so they can meet the requirements

First off if you get stopped, the Officer is doing thier job not harassing you. I think people that think the Police just harass people should call a crack head the next time they are in trouble and, see if that helps...Second I think the blue sticker for handicap people is a great idea, that would help everyone, including the Officers...

i agree to a point except the fact that i have been harrased on my enduro bike although it is street leagle it has a headlight tail light and brake light horn and mirror it still looks like a dirt bike and i get the YOU CANT RIDE THAT ON THE ROAD!!!! then i show them my registration insurance and all that jazz and have to explain the fact that it was inspected by the sherrif department(and onetime the guy that pulled me over even called another car that was in the area and the was giving me a real hard time about it till his backup arrived and it was the sergent that inspected the bike and had to explain it to him ) my bike was a duel sport but i stillgot a hard time

All I can say is your are going to get that, not all the time, but it does happen...most of the people Police encounter lie to them to avoid getting in trouble, hence you get the treatment you get, but I still wouldn't call it harrassment...

yeah damnit! so you better just bend over and take it and not complain because if you do, you aren't supporting the police!!!

Ok lets get back on topic, bashing the cops isn't in fact the topic as of yet. I personally have never been stopped on my quad. many people I know have been on Dual sports and they have had a hard time trying to prove its legal and has been inspected. You would think if it has a plate the officer would assume first that it is legal rather then the latter. the idea with the Blue ORV sticker is just that, make it legal in the eyes of the law so as to avoid such confrontations.

well I wrote to Steve Kubisiak up at the DNR. he wrote back about the idea saying it didn't merit any attention. he said he didn't think the state would make any extra effort to make stickers for one group. sounds like a bunch of personal oppinion and nothing in the lines of presenting it to the ORV board or the S.O.S.. Guess I'll make a few more calls to see what I can get done.

I'm not at all surprised. Some of the top brass at the DNR have to hold themselves above the general public, or at least it seems that way with some of the crap they pull.

Could have saved you the time! The DNR is the biggest 'Can't Do' group in Michigan Gov't today. What we need to find is a handicapped Legislator that rides an ORV. Get them to initiate legislation based on a need, compliance with the ADA Act, or safety. Short of a Legislator, it will be tough road to hoe. Just look at the ORV's on the shoulders legislation. Don't think that there hasn't been back door meetings on the doom's day scenarios if that legislation passes.

It would be helpful in your posts on this subject for you note, this Handicap ORV rules apply only to state of michigan lands. It does not apply to National Forest System Lands. ORV/Atv use is only legal on designated trails. Use of non street legal vehicles on any National Forest road, even if the rider has a state of Michigan handicap authorization, will result in a ticket. The State Handicap authhoization will also not work for travel behind closed gates or roads, or for cross country transport of down game.

If riders plan to visit the National Forest in lower Michigan, all will need to stay on the designated trails and off the road system.

If folks have other questions about this they can contact any Huron-Manistee National Forest Office.
