I hope that wasn't directed at me. I'm not sticking up for Dave or the situation. Fact is, even if I wanted to, I don't know enough about what happened to do so logically. But I don't want to....like I said, I'm reserving judgement. I'm simply saying it's not always as cut and dried as straight up drunk driving. I agree with your points, if you're impaired in any way you should not be behind the wheel, period. But legally it's not always that simple. If you consume anything, impairment or not, below the legal limit or not, there's potential to get in trouble. That's the only point I'm trying to make.
Just to play devil's advocate in regards to the grey area of impaired driving, I'm sure there have also been illegitimate cases of charges against individuals too. Again, I'm not trying to justify any of this or state an opinion one way or another. But mistakes happen. Not all cops are good, or even a good cop may have a lapse in judgement. They're human, it happens. Statistically speaking it's pretty much guaranteed that there are people who have been wrongly accused and wrongly convicted of impaired driving based on the way the law is set. The same goes for just about any law really. It's not a perfect system and it's run by even less perfect humans. Did that happen in this case? Doubtful? Does it happen in most cases? Even more doubtful. But it does happen.
Example: Ever miss seeing someone in your blindspot? Or spin out on ice? Or not see someone coming at an intersection? Any one of those could result in an accident. Now what if you had one or two beers in your system? The officer smells it, your driving and impairment comes into question regardless of whether or not that in any way played a role in the situation, and you've gone from an accident victim to a suspect. Simple as that. Sure, in most cases justice will prevail and you'll be on your way. But that's not always the case. When it comes to impaired driving of any kind, consider yourself guilty until proven innocent. We all know the risk of driving drunk, both personally and legally, and we all agree if you choose to do so you're an idiot. But not everyone understands the risk of driving sober after drinking small amounts. I'm just trying to shed some light on that risk. Are you a danger to society and others on the road? Not likely. Are you at higher risk of getting burned by the legal system? Absolutely.

Not directed at you, just in general.

This is all around very sad. I'm a friend of Dave's. Not to take anything away from Jeremy's family or anything like that but that accident destroyed two lives and two families. Dave has his own family that now has to deal with this and I'm sure it's pretty much destroyed it, and Dave himself, and his career. I think and pray for both families daily. I can't imagine the pain.
