Default I need advise on a problem i am having with a home contractor

I hired a contractor for 10,000 dollars of work on my home. He had received all payment other than 2,000.00 I am holding due to the garage door not being completed. The garage door part of the job was put into the quote for 2,000.00. On the bottom of his invoice it says balance due upon completion. After the initial work was done I was not satisfied with the door panels which were obliviously damaged in shipping. Contractor quoted me 3 weeks to get new panels in and get them installed. I call him every week and ask him what the status on the new door? His reply is, he sub contracted another to do the work and is surprised that I have not heard from him. Another week goes by and my contractor tells me that the guy he hired needs to have surgery and he doesn’t know why he has still not contacted me. 8 weeks has passed now with no answers. I told the contractor I hired that I will be looking into hiring someone else to finish the garage door. I need to know how to do this legally. I don’t want to pay two people for the same job. I’m not looking to make out in the green either; any money left over will go to the original contractor.

Well If balance is due upon completion and he doesn't complete it then you shouldn't owe the balance.

You hired HIM to do the job. It's his problem he sub'd it out.
Tell him you want the job finished by friday or you will hire another contractor and he will not get his 2k.
Document your conversations incase he tries to sue. He will lose.

I agree but i need to be legal so he wont place a lean on my house if i only give him a portion of what he quoted.

Are you selling your house in the next year? Leans are useless if they are not renewed.
He did not live up to his contract. No court will buy the "my subcontractor didn't show" argument.

sounds like the original contractor needs to cut his losses and sub out to another garage door contractor. the sub having these issues are HIS problem, not yours.

your contract is with him, not his sub.

he needs to chalk this one up to school of life. you are his customer. he needs to make you happy.

I he licsened and insured? If not then he has no recourse on anything. If he is then send him a cert. letter and tell him X date and I will hire a new one.
