Default wetland laws

I am looking for laws governing the use of wetlands or similar types of lands on private property.

No opinions or regurgitations. Please post links to actual laws or government websites.

I think that the next thing I need to know is definitions of wetlands. I had a conversation with the DEQ lady and she said that if water sets on the land for 3 weeks or more it can be a wetland. I think maybe I didn't get the whole story there. or did not understand something she was saying.

I believe the "accepted" definition comes from the type of vegetation found in the area. If it is covered with cattails it is definately "wetland", etc. I have a friend who does land "development" and he has extensive experience with the DEQ on this type of question.
The fight comes down to the duration of the "wet" area ( times of the year it is wet and for how long) and the types of vegetation in the area being discussed.:chiefwoohaw:

If it supports 'wetlands' type vegetation, i.e cattails, it's a 'wetland'. Kind of like the duck rule.....if it looks like a duck, walks like.....
And NO, private property is not exempt.

the only part that may fall into exception is what I have in my yard. its a farm pond under 2500 sqaure feet. you do not need a permit to dig such a pond if you are 500' or more from any other stream or body of water. the county guy here said I can do pretty much what ever I wanted , and it didn't matter if I mud bogged it or not. its been 6 years since I dug it and it just about drys out completely in summer. it has about 100 square feet left at its worst when it drys down. the best discription I have is what my friends call it...."The scud missle site"... just a big hole with very little water.
