There are a lot of exemptions to the overtime/1.5 provisions, unfortunately.

I get f'ed over there because of the computer occupation exemption.

Your right, it is wrong for how it works.

I guess in this day and age, having a family to support, I will keep my job if it means I have to deal with a little shit then so be it.

This isn't why the unions were started, and the unions are the fucking reason people have to worry about their jobs because they are tougher to replace.

30 minutes cost what 20 bucks?
Lost job costs?????

I know, hindsight is 20/20 but pick your battles and you will find yourself alot happier.

You were working for jews and didn't realize you were going to get fucked? There is a reason they squeek when they walk.

Best of luck! I would keep my eye open but Saginaw is the armpit of employment and long ways from Novi.

Sorry to say that I think your screwed as already stated. But I don't think there is a law that states if you work over 40 hours you are entitled to time and a half. As long as they pay you your wage I think that is legal. If that was the case truck drivers would be making a killing, since we work 70 hours + a week. OT is based on what the company offers.
I also think that making you sleep in a trailer is bs but is legal as long as they provide accommodations for you. You should not be forced to share a living space with another person unless you decide to do so though.

I'd call the labor board and see what they say, but like I said I think your screwed.

Not to be negative norton, but your screwed. As a at will state, they can fire for what ever reason when ever. As for the over time issue, there is ways for employers to get around that also. ask anyone that works for lowes, it is called "Chinese Over time"

Im sorry to hear what happened, but this day any age the legal system wont help in these kind of cases..I know first hand I got fired fro having surgery from a injury I got while on the clock and they still had the right to fire me because of the at will law

Good luck

Look up concraft in aubrun hills they are a great company for insurance restoration

Overtime for more than 40 hours per week is required. Travel time is not.

did you read my post?

time and a half for OT IS a national legal requirement, but there are many exemptions. Michigan also has a time and a half requirement as well.

from http://www.dol.gov/dol/topic/wages/index.htm:

Quote:
Workers who are covered by the FLSA are entitled to a minimum wage of not less than $5.85 per hour effective July 24, 2007. Overtime pay at a rate of not less than one and one-half times their regular rate of pay is required after 40 hours of work in a workweek. Certain exemptions apply to specific types of businesses or specific types of work.

from http://www.michigan.gov/dleg/0,1607,...9647--,00.html
Quote:
* Provides an overtime rate for non-exempt employees of 1½ times the regular rate of pay.
and from http://www.michigan.gov/documents/FS...s_169940_7.pdf

Quote:
Provides an overtime rate for non-exempt employees of 1½ times the regular hourly pay rate, for hours worked beyond 40 in a seven-day workweek. Michigan law has been amended to align it with federal overtime provision that have been in effect in Michigan and that exempt certain categories of workers from overtime pay. Such categories include truck drivers, television/radio announcers, news editors, taxicab drivers, newspaper employees, live-in domestic workers, commissioned sales staff, nurses and computer analysts. Michigan law, however, has also extended overtime coverage to some at-home health care and day care workers.

Call the policy and procedure folks you called in the beginning and ask them about it, and/or contact a lawyer. There is a lot of bs being spewed in all ways by folks who don't know shit on here.

contact the michigan dept of labor and start spilling the beans. give them the contact info for the payroll provider. i don't think you want to work there anyway. having you bunk with 9 others in a trailer while the company gets hotel rates for 10 should tell you how cheap they are and not at all interested in keeping good workers. as others have said, this does not sound in line with the purpose and intent of the fair labor standards act (FLSA).

Being 1 minute late and docked a half an hour is not that uncommon. Home Depot does it for when you punch in and out, but theya re 15 minutes.

All you had to do was keep your mouth shut and punch out 1 minute late to get that half hour back....
That is not completely true.... when I worked there people always played the time clock because of the way it was handled. You could be UP TO 7 minutes late and NOT be marked late and get your full pay. AFTER 7 minutes you would get docked for being late (the 15 minutes pay).
