Talking good day and hopefully i get fawked

long story short

i left a good job for less money doing disaster restoration work. the company i went to i had been working with the owner to get in for a about a year. the day after chistmas the owner from the company (maximum restoration) called me and said he wanted me to start asap. i told him i am looking for a long term job and he said he wanted the same so we agreed on a salary and i started. well after about four weeks i punched in a minute late and they told me they take a half hour off you time for being late while making you work. i said this is bull shit and nobody would give me any answers to why i was not told this or if this was lagit. so i called the policy and procedure company/payroll and asked them why it wasnt in the book. they said that is not legal and would notify the company. i get back to the shop and they say theres no work were letting you go, how ironic. so now i am unemployed and looking for work so if anyone has a job opening or if anyone needs any work done to there home or office let me know. this sucks even more due to the baby on board.

does anyone know if there is anything i can do because of me leaving a better job and being let go so soon, legally.

also about the irony of the situation with them docking pay while requiring me to work.

You left one job for another, you got fired, nothing illegal about that.

The other part, i would look at your contract and see if that was in there. If not then you may have some recourse.

I believe because of michigan's right to work policy you are fucked.

Why do people feel the need to argue about small things so much? Had you not bitched about the minute and learnt a lesson for the future, you likely would still have a job. In this economy unless they are pulling my pants down and really laying it to me, I think I will keep my mouth shut about the petty shit.


Don't mistake the above for not being sympathetic. I am sorry to hear about the loss for you. Best of luck finding something to replace it.

Adam, I remember reading: Employers are obligated to pay for all time worked. Some rounding is permissable under federal wage and hour regulations, but rounding must be set so it does not always benefit the employer.

Most adopt a quarter of an hour as a convenient chunk of time to use for payroll purposes. Ideally, if an employee is up to 15 minutes late, the employer says "you lose 1/4 hour of pay, but you don't work for that 1/4 hour.

Something is fishy. I suspect there is more to this than you are saying. I have never seen an employer do that without something leading up to it. If you are good employee, they would be likely to give you a warning.

It's at-will in Michigan. Right-to-Work is something different, mainly not having to join a union if you don't want to.

something is fishy about the company because they were also doing other wierd stuff.
say you work 8 hours and get called for an emergency out of state and it takes 4 hours to get there and it puts you into over time the were only paying straight time wich is against the law for hourly employees because if you work over 40 0r 80 you recieve time and a half for those hours. also they were not paying guys there per diem for going out of town. also if you go out of town insurance companies pay for a hotel. they went out and bout a trailer and put 10 bunk beds in it for the guys to sleep in.

i spoke up because i dont want to start off working for a company that i plan on working for for a long time getting screwed. to me that sounds like a ride ti dont want to take.

so because they can fire me i am suposed to shut up and take it. no that doesnt make it right.

Correct michigan is not a right to work state it is an at will state. Whcih means you can quit at will and be fired at will, no reason needed.

Being 1 minute late and docked a half an hour is not that uncommon. Home Depot does it for when you punch in and out, but theya re 15 minutes.

All you had to do was keep your mouth shut and punch out 1 minute late to get that half hour back....

and actually 90% of the staff was black and all management jewish. they just started hiring white guys within the last 6-10 months.

i think i will call the labor board and have them investigate it.

no 1 minute late negative 30 minutes. if you punch out a 2 minutes late it goes back. the clock is set up for a win win for the company wich is also illegal. i used to work for home depot they use the 7 min round up and down method. so if you were within 7 minutes late you were not considered late.

This is why Unions got started because of this thinking. If you let them get away with this, even when there head company said it was not legal, then the company is going to think they can get away with taking a little bit more each time. If you don't speak up about it, nothing will happen. A lot of small things can add up to one major problem.
