The Oregon Supreme Court made the ruling. It was not a lawyer just filing a case.

Yes I read it and there were lawyers that got it there. and you can bet they got a pretty penny doing it.

The only thing this ruling does is allows it to go to court and let a jury decide. The case was originally dismissed by the circuit and appeals courts. The Supreme Court is just forcing it to a jury trial.

I would think that the onus would be on the plaintiff to prove that the part had failed to do the negligence of a specific owner during the time in which they were in posession of the vehicle.

The defendants had to have had crappy representation. I'm suprised the judge even allowed it.

I don't know about anyone else... but I'd probably inspect an axle before buying it, and especially before putting it under a vehicle. You're tellin' me something that causes the axle to fail so blatantly wouldn't have been noticable if someone had just taken the time to look at the damn thing?
