OK, now I think I am screwed. Before he came I sent the title to his bank, they said he would bring the check. Well as you read, he didn't. Now they don't want to give the title back to me because they said they gave him a check. He called me and wants his deposit back. The bank has not signed the title over to anyone or anything, so at least they own it instead of him. The bank thinks that I am trying to screw THEM? WTF?!?!?! I imagine it should play itself out, but in the meantime I can't sell the car?

Furthermore this cat is starting to threaten me. I wish he was emailing me so I had a record of the things he is saying, can you get cell phone transcripts?

Yup I had a feeling. The 'bank' has the title...he was going to take that car for a ride and you would never see it again.

Sorry to hear this man. Is the bank legit? My sister tried to have some guy from Kenya rip them off with that estate scam that was going around. My brohter in law was in contact with a bank that seemed 100% legit. When you answered, they answered it as the bank, they had hold music, and people act as different departments...etc etc. Scammers are very smart and normally cover all their bases.
At this point, I think I would be contacting a lawyer.

Keep a log of every time you were in contact with him and what the conversation was about. That's what was recommend to my sister & brother in law via authorities.

Yes the bank is legit. I talked to the bank, I'v edone the send the title thing before and I know it is legit, but the bank is giving me crap because they think that I am the one who was trying to scam and steal my own car?

Turns out he isn't even a member of said bank, he did apply for a loan, but they have not heard from him since he flew up here to look at the car.

inform the seller that I had the insurance on the car, and made arrangements to take the day off work, secure the bank check and pick up the car for a Friday.

now keep in mind, this is a 6, or 7 year old car at the time, and he had a brand new infiniti in the drive way of his $750,000 house in clarkston (I looked it up - i have access to that information) - he calls me the night before - "I can't get the title in time... I have a loan on it, from one of those internet companies, and the title is in texas..."

He had been such a pain in the ass, had numerous opportunities to mention that little nugget, etc, it was simply the last straw - I wished him the best of luck in selling the car, and walked away.

call the police department, and get a case/file/report started asap, along with a log of every date/time he contacts you, and/or you are in contact with the bank.

If you have a lein on the car you should talk to your bank immediately.
Make a police report as a matter of record.
Type up a very "detailed" time line of every conversation, dates, times, etc.
Ask "his bank" for proof that they issued a check.
Ask his bank if the check was made out to him, you or both of you.
Call the secretary of state & explain the situation and get an opinion.

Important: Get the name and title of everyone that you talk to from here on out.
Tell him that if he wants his deposit back, you will trade it for your title.
Time to get "all" of your ducks in a row.

Put the car in a "safe" place.

You have some safety here if you have a lein, you legally can't sell the car because the bank holds the lein. Second, if there is a check out there floating around, you don't have to give up posession of the car until your bank accepts it as legal tender.

Have the originating bank trace the check to see where it was cashed. The authorities can then watch security videos to see whom cashed it.
