Default Opportunity to keep Kids in the Mudd Open

I got off the phone a few minutes ago with Dave, the owner of Kids in the Mudd Off-road Park in Decatur, MI. Many of you know he opened the doors this past spring and the township has closed him down. There is going to be a township meeting on January 9th, that I plan on attending, but the park could use letters written to the township to show out support. This is your opportunity to speak up and have another option in Michigan for wheeling. I have attached the link to his website with the information of where to send the letters. If you have any questions please feel free to ask.

Can anyone reseach the existing area, if you can find other "Buisness" operating in a Zoned A1 or Agracultural area - you can use that information as "precidence" for his buisness operation.

Usually these restrictions are enforced from neighbor complaints. So it will be a tuff battle.
If the planning commitee will not allow it. He should be able to apply to a Zoning Board of Appeals (ZBA). They interpret the zoning law and determine if the law is prohibiting. He will also be able to take this to Disctrict Court to get the property re-zoned if need be.

Bummer I just found out about it, its only 45 minuates away!
Unfortunatly I will be unalble to be present for the meeting. But a letter is being finalized now, if anyone can get me a reference buisness for my letter I will include it.
We are looking for a home "based buisness" - daycare, dog grooming, etc.

There is a history of when he first opened the property to off roaders. His property is zoned as agricultural which in reading the Michigan laws states that the owner uses the land to meet his needs. Many of the other properties around him lease their property to hunters and other things like that. He went to the DNR, state land surveyor and a lawyer before ever opening the property up and got the go ahead. The township closed him down a few months later stating that they had received a complaint. His lawyer asked to see the complaint and found that none had been filed. This meeting was supposed to happen 2 times before this and the township has found a way to keep delaying it and hope that Dave just gives up on the idea and runs out of money for a lawyer. Even with the letter the township wrote about the hearing they put the address in wrong. The lawyer feels that the township is going to say it has to be delayed again because of this error. The meeting is going to be videotaped and if this happens I think there will be some law suits because the township has no basis on why they are keeping him closed and they have delayed the hearing a couple times now on their own mistakes. I and a few others that I know are going to be there to see what happens.

I am a little rusty on my township zoning regulations, but I am pretty sure that an off-road business does not fit under Ag-1 zoning restrictions. A special use permit or a rezoning would have to occur to fit the zoning requirements.

This is the part that is being delayed. He applied for it early this past summer and has yet to be able to have the hearing because of the run around the township is giving him. They just don't go by the rules. When I contacted the Marines about the TFT run we did I found out that Decatur was almost sued by the Marine Corps because of using the TFT name and logo last year and never asking permission or going by the TFT rules. They collected their own toys from within their community and then handed them out. Someone complained to the Marines that all they got was dollar store toys and that's when the Marines found out what had happened out there.

If you haven't been out there it is a great alternative to the Mounds if you're looking for mud. There are some good woods trails and hills to climb also. Here's a link to pictures of the TFT run that was held in December.

Roger - it's already late on the 3rd with a weekend in the middle - is there a fax machine at the township office we can fax to? Or some alternate way to get it there?

Jason and others. I found out that the township is only open part time and they do not leave their fax machine on unless someone is there. There is no guarantee that they will be in the office to even turn the machine on until next week. Please use fax number (269)468-7478. This is the fax to Dave, the owner of Kids in the Mudd. He will ensure the letters are turned into the office in time next week.

i guess im wondering if theres anything specific we could address in these letters. ie. do we know what the complaint was about (real or not) traffic, noise ? other ?

ive never been to a park where the neighbors are happy to see you coming - its that best behavior thing where you have to be twice a nice to be percieved as just ok.

if its a show of numbers thats one thing, if were trying to address a specific issue it may help to know that. also, if the letters repeat themselves over and over in content is that a good thing ? not sure - just wondering whats most effective.

What's funny is that several of his neighbors came over to the TFT run we did there in December and helped with cooking and setting things up for all the people we had there. They seem to be very supportive of what he is trying to do. From talking with a few of them as well as Dave there have been other business ventures that people have tried to bring into that area that the township has stopped and put a hold on. I think the people are just tired of the township and the way they manipulate the system by dragging things out to the point that the other party can't afford a lawyer anymore and the township wins.

so maybe just some bad eggs in the township ?

thats too bad - people are just plain weird sometimes.

im out on a project during that meeting but ill get a letter together and fax it over. (assuming thier machine is on)
