So you were living in calorado at the time? Was anyone in the residence when the crime happened? In order for home invasion first some one has to be in the home.

You have no clue what you are talking about. I was living in Colorado from march - end of November. The dude just got sentenced for 1st degree home invasion. I'm pretty sure his lawyer would have caught that one. The court was sending me paperwork in Colorado and my dad was taking care of stuff in Michigan for me.

He was just sentenced to 3-15 for; 1st degree home invasion, unlawful driving away and resisting arrest.

I believe your thinking the person has to be home for this charge ? When someone breaks into a house and the owners are home this is the first charge then the list go on from there. I think breaking and entering is used when its not a home like retail store or storage unit.

There was nobody home and that was the charge. Nobody had been there since march. I'm no lawyer but that is what he was sentenced for so I would say that it is a fair assumption that nobody needs to be home.

Thats what I half assed tried to say. Home invasion is just that . Nobody needs to be home for it to happen. I believe the charge is more serious than breaking into something else like a car or store front.

I was trying to explain to go1lum that when you watch the news or read the paper they always mention Home invasion when someone is home. They never report a breakin as home invasion for some reason .

They would have gave him 2nd degree if he wouldn't have stole the guns. The guns bumped it to 1st. The others are getting 2nd I believe.

That's what I mentioned in your other post awhile ago . Most perps walk on first offense like this. I hate to see guns get stolen but this helped in your case.

He had multiple misdemeanors as a minor and adult and other felonies as a minor. He is only 19 so he hasn't had much time to commit crimes as an adult. It sounds like he went back to the house multiple times.

His relatives all want him to go away for a long time it sounds like. He isn't welcome to stay with his family. Hopefully that gives him incentive to move elsewhere.

Breaking and entering is simply that; breaking in any public or private bldg. without permission.
Home invasion is specific to a home or dwelling with 1st, 2nd, and third degrees based upon intent while enering and actions while inside.
