Dad got a ticket

He works for Waste Management. He was in Rochester and was getting ready to dump a recycle dumpster before 7 a.m. In the city of Rochester, you can not dump trash before 7 a.m. The regular garbage dumpster is in front of the recycle dumpster, so he has to pull the garbage dumpster out so he can get to the recycle dumpster. He has been warned about this 2 years ago, so since then he has been very cautious about this. Anyway, as he pulled up and got the forks of his front loader into the dumpster, he saw the cop parked behind his truck. When he saw that, he backed up, put the garbage dumpster back, and then left. The cop pulled him over and gave him a noise ordinance ticket. Apparently, it is a misdemeanor. He did not dump the can, so how is he in the wrong?

He said two weeks ago, a guy at his work go pulled over in the same area for the same reason. He didn't tell the officer he had a CPL, nor did he have his DOT medical card on him. My dad did the complete opposite; told the officer he has a CPL and had his DOT medical card.

GL4x4 court, what do you think?

I would think because the last guy didn't do it right the last time, he would go easy on my dad for being professional about it. I think he said it was the same officer.

Ahh... Doesn't make it right that he was waking up the great people of Detroit before their noon alarm. Who has a noise ordnance against the fucking garbage man? Retards.

I work for Republic Services over here by Grand Rapids. If the cop seen him move the trash can then he had every right to pull him over and wright the ticket. The truck it's self makes enough noise to warrant the ticket. If he is just driving down a main road and not a side street or residential street then he is fine but as soon as you pull in to a parking lot or down a non class A road then you run the risk of getting caught.

As for the CPL and DOT card I don't know why that would have anything to do with it.

You would be surprised. We deal with the noise ordnances all the time they range from 6am -8am and some city's have a 10am ordnance on Saturdays so it really sucks the Saturday following a holiday when we have to make up a day of trash

Yea, he was in the Morgan Stanley parking lot on North Main Street. So I guess the officer had the right to pull him over and write him a ticket.

He is mainly concerned that it is a misdemeanor. He doesn't know what this will do to his license and/or his CPL.

How the hell do city people live like that? Shit when I worked in town and the tractor dealer out garbage got picked up at like 4am. My moms is picke up early too. Luckily I burn my but only the plastics I recycle the paper and stuff.

It should be an arrestable offense to complain about someone making noise as the result of working. People are trying to get stuff done, you hippies.

Shouldn't do anything to them. Every moving violation ticket you get is at least a misdemeanor if I'm not mistaken. I could be wrong so someone might be able to correct me on that. I'm not sure how Waste Management is but our company pays those tickets for us.

What we do at our shop if someone calls the shop to complain about noise we wait about 5 min past the noise ordnance ie 7:05 and make as much noise as we can. Rev the motor when picking up the can bang the can hard over the truck to make sure there is nothing left in the can then drop the can on the ground and slide it across the parking lot so it back in the exact spot where we picked it up from. Then back out of the can nice and slow so the back up beeper is going off as long as it can before you leave.

He had to state he has a cpl even if your not carrying it's the law. I also work for wm and got the same ticket a month ago in Novi. I was in an industrial area and the cop still wrote me a ticket. Best bet for your dad is to pay the ticket and tell Chris (I assume that's his supervisor) that he got the ticket and can't be back there until after 7am.

Yes we can. I also like to move very slow thru a parking lot when someone is very impatient and getting all pissed off because you are doing your job.

Not all misdemeanors effect firearm ownership/CPL status. A noise ordinance should in no way effect his CPL. Violence, intoxication, or for things like stalking or whatever else might label you mentally unstable effect a persons CPL. Not sure of anything else.

Thats not what they are saying. In Michigan, if you have a cpl you are required by law to immediately inform an officer of the law during a traffic stop.
