Default Will Sandy change the election?

I was just reading an article about Obama talking with NJ Governer, saying that they would not quit until they were finished. That got me thinking....

Is there any legal precedent that could alter the day of the election? Either canidate that looses (especially Obama, most east coasts states are blue states) could say they the people who whom have been displaced by the storm don't have the opportunity to vote, there for, the elections results aren't valid, and forces a re-do for late November or so.

I could see Obama pulling an Presidential directive postponing the election day, to give poor, and underprivileged democratic voters an opportunity to collect their life, and then worry about voting later.


Thoughts?

Shit Happens, Who ever wins this election I can see no reason for a "Do Over". I hope and pray to god that Obama does not win. If he does then we move forward with his as our president.

Presidential elections can not be rescheduled. But rules are overated as has been shown by our govt.

Interesting question. This is what the Constitution says about setting the election date:

So in theory congress could decide to change the date. I don't see it happening this year, but I could see that if a storm like Sandy was going to hit on the day of the election that they might postpone it.

Is there a time limit? Say, can't change it... with less that 2 days remaining? Could a Executive Order push it, and over ride Congress?

I don't see anything about a time limit in the Constitution. There are certainly federal laws concerning it.

Per the Constitution the job of setting the election date is solely up to Congress, so no, an executive order could not do it.

It could still make a difference. Urban areas tend to be more democratic and rural areas more republican. If something happened that effected one more than the other it could sway the vote in that state.

Actually what it says is "if the supreme court gets involved all bets are off."
