The will sometimes "double charge" as a safety net also.

e.g. The Jury may feel he was insane during he actual killings, but the fact it was planned and pre-meditated in a complex manner will show he wasn't insane during that part.

Prosecutor trying to cover there ass. It is possible for him to be found guilty of one an not guilty of the other.

Yep, absolutely. Lot of prosecutors guess wrong on this. Sometimes someone will walk away from first degree murder charges, when they'd have been convicted of second degree, IF the charges had been placed. You want to find as many possible ways to make the charges stick, incase he gets out of one under some loophole.

Not defending the guy in any way shape or form....

But with a justice system as fucked up as one that can charge someone with 24 counts of murder when only 12 died, I wouldn't blame him for copping insanity. He either killed 12 or he killed 24. His mental state, planning, deliberation or "extreme indifference to the value of human life" are irrelevant to the FACT he killed 12, not 24 people. This is nothing but injecting emotion into the legal system.

There is a reason Lady Justice is blindfolded.

You could buy enough rope to hang him for the cost of a couple gallons of gas, plus the rope is able to be used again on another criminal.
