If I understand your situation correctly you and your cousins are lucky you are getting anything. I assume there was no will. Assets would normally pass to only the remaining immediate heirs - your living aunts and uncles.

I am in a similar situation. My Dad died in April when his aortic annueysm burst 1 month before it was to be fixed. My grandma, his mom, died a month later. It all depends on how her will is written, if she has one. The key phrase you need to look at is if the assets are divided "per stirpes". It is a Latin term, it basically means that if one of your grandmas kids should predecease her then that kids share is given to their heir.

My grandmas will says that, I wish I didn't have to get her money and my dad was still here but unfortunately I can't change that. But I will make damn sure everything is done fairly for my brother sister and myself. I love my dads family and they are doing the right thing, luckily they are not jack asses and are doing the right thing.

That being said, if you are owed that money then screw your family and make sure you get it. Your grandma wouldn't have set the will up that way if she didn't want you to have it, assuming you have a will.

If there is no will or it isnt written "per stirpes" then suck it up, be happy with what they are giving you and move on. You will have no legal recourse to take and they will have no legal responsibility to give you anything.

I truly hope you get what is yours, if you don't you will have a sour taste in your mouth about your family the rest of your life and you might as well have told them to fukc off to get your full share.

wow LOTS of confusion here. sorry about that. i asked a question, didnt ask to be judged...

anyways my grandfather was pretty loaded and had his own woodworking shop with lots of high dollar tools and machines, ect., ect. and we've already had this problem with his estate. we had to go threw a hugh hugh mess because one of my aunts is a greedy pig. now she dont work and has a 200K house thats paid for... i didnt really have a big fall out with this family but they are known for fucking other family members over big time. when my dad passed away the took most of his jewelry he made and now its just gone. whn my grandmother passed away they did the same thing, what ever they left me with one unfinished ring(that i hope to finish someday) that my grandmother got from my father and a few pics. not trying to be greedy just making sure im not getting fucked over.

and yes i was the grandkid that was always over there. she loved to do yard work and to have a beautiful lawn. when she got to sick to do it anymore i was always over there mowing, gardening, turning the compost pile, trimming trees, racking, chipping fallin branches, ect., ect..

oh and im not planning on sueing anyone. im just taking the first step to make sure im not getting fucked over. thanks.

Is it enough money to warrant paying a lawyer to handle your claim to the estate? If it is then do that, if not then be happy with your 1/7th or whatever it is.

no she did not have a will kerryann. my cousin became the trusty. there are a couple other things that arent right but it doesnt really bother me. they did do the work to get it to where we are now.
