Default Does Ebay seller have to sell the item to me even it is was priced way to low

I was the winning bidder (only bidder) on an item that was listed in the wrong category and had no reserve. So I won it for ridiculously cheap. Now is it the guy required to go thru with the transaction or was I just wasting my time. I haven't paid for it yet so I am not out anything, I bid on it more out of curiosity to see what would happen. By the way it is a car, if that changes anything.

Yes, he is required to honor the deal. BUT as long as they have no regard for their seller rating the can opt not to and possibly get booted from Ebay. There was a deal like this when the PS3 came out that where someone listed on as buyitnow and left a couple zeros off the price. IIRC some lucky person got one for $100 or so.

What was the item and how cheap was it? (If you don't mind)

I dont want to say because it just ended tonight and I want to see how it plays out, but if it goes south I will post it on here, possibly with a link to the auction. All I have done so far it sent the seller a question saying "When is a good time to pick up the car? I assume I can drive it home?"

Be sure to save the pictures in the ad and the listing itself to your hard drive for proof of the vehicles condition at listing. Just in case it has an "accident" while still in the sellers care. Ebay can be very helpful if situations like this happen to go south, so if things get weird be sure to clue them in and having as much proof on your side will make it much easier to get things taken care of.

I would check ebay's rules but if it was not listed in ebay motors under vehicles then it may be void, only because Ebay charges an even more ridiculous rate for vehicle sales than they do for regular ebay motor auctions. Not saying this is the actual case, but in the past i have had ebay void an auction of mine that somebody won because they felt the shipping was higher then average and thought i was listing the item for less and charging more for shipping to screw ebay out of some of their fee money. That was before their recent change of course where they now tack their fee onto the shipping cost as well.

He will most likely not follow thru with the deal. I bet he has little to no feed back rating. You will open up a case against him, nothing will happen, you will have the opportunity to leave negative feed back and he will continue to use Ebay. Ebay will not kick him out unless this becomes a recurring problem. How many feed back ratings does he have?

By the way, I have purchased large items off of Ebay for pennies on the dollar and had the deal go thru just fine. I paid $400 for items that I resold for $5000 due to the first add being very shitty. I wish you luck. It all depends on the seller.

Worst comes to worst just tell them you will be contacting your lawyer. Don't expect ebay to enforce anything more then you hurting his rating. They do not get involved in such matters per there terms and conditions and actually recommend you hire legal advise to resolve any issues if you can not come to justifiable terms.

If he does regretfully agree to give you the car I suggest that you closely inspect it for damage or missing parts. People can do stupid stuff out of spite and once it is in your possession it is impossible to prove that you did not cause the damage.

One you post something for sale someone commits to buying the item then it is a legal binding contract, read the ebay policy man....

Pay for it and that way he can't do anything like backing out of the deal

ebay is a legal, binding contract. If it's been sold for a retardedly low price, that's on the seller. your bid seals the deal. seller could have set a reserve, or sold it as an online ad, like craig and his list. if it's something real cool, or worth pursuing, a law firm will type you out a letter of intent for pretty cheap.
