Traded truck on "as is terms" and now its broke....

Earlier this afternoon i traded a 1995 eagle talon for my dodge ram 1500 mudtruck. When it left this house it did not have u joint problems. Now the new owner is broke down on the highway with a ujoint broke, which dropped the drive shaft, which cracked the transfer case and destroyed the transmission.

There was an official agreement that he signed stating that this vehicle was being sold on "as is terms" and that i was no longer liable for it in any way shape for form.........


Pickup was running great when it left this property. Can he hold me responsible for this truck being destroyed, almost three hours after leaving my property?

save that piece of paper and your good to go so long as he signed it.

He was probably beating the hell out of it and broke it anyway.

Sounds like you will be fine. It sucks that it happened to him but that's a chance you take on something used.

My guess is it bent the t.case output, cracked the case, and cracked the trans tail housing. He probably needs:

T.case... $150 used
Tail housing $100 used
u joint $30

so $280 give or take a few dollars.
and a days worth of work.

As is means as is. It sucks for him but shit happens. It most likely had the u-joint going out and it snapped up him, it is just shitty luck. When I was 18 I bought a K5 Blazer and the next day the trans blew. There was nothing I could do about it. i just accepted the loss and fixed it. It is all a part of buying used from a private party.

just stop answering his calls. lock up your car, and insure the hell out of it.
a game camera nearby is a good idea too.
i always keep extra keys to the cars i sell, just incase there is an issue later.

I do not have a game camera, but i did tie up my 140lb male dog up to my ranger which is parked in front of the new car. I plan on getting the title switched tomorrow, and putting some really good storage insurance on it.

I know i can still get sued over this issue, but i dont think he can win with that paper he signed about "AS IS".My biggest fear is that they come mess with my property. I have decided to not communicate with these people anymore

Is the new owner mad ? I am assuming that since this thread exists he is even though you didn't say so.

If you have a piece of paper signed by him saying the vehicle was sold as-is you should be fine.

If Tranny Tom's estimate is anywhere near right and it is $300 or less to fix and he is that upset I wouldn't worry about him having the money for a lawyer.

I'd keep a light on though and have the neighbors keep an eye out in case they try something stupid.

The part that he claims broke, causing this chain of catastrophes in the front end, had less than 3,000 miles on it. Babied miles, just normal driving....not even any trails.

I took the talon title to the dmv, and put in an app to have it transferred into my name. New title should be here in about one business week. Newest info....that's been created was that my dodge RAM 1500's driveshaft had been welded back together. Out of all the mechanics that had looked at that truck during my ownership...one of those people would have noticed that and told me.

Whatever....even if it goes to court..it was traded as is.

in the state of michigan when you sell a "used" vehicle it is ALWAYS "as is" unless you have a written/verbal warranty but verbal would be about impossible to prove unless he had witnesses, i would say there shouldnt be any problem... and yea he could sue you..i could sue you right now but i would no way in hell win..and unless YOU SIGNED a paper sayin you warranty the truck for X number of days than he will lose for sure....

I hate to say it but ,in mi. You can pretty much sell anyone anything as long as you dont have a dealer license and not worry about it,if you can sleep at night.so you got nothin to worry about.it may have got a lil sticky if it was in accident and some hungry lawyer got your number.
