Republican Rep. David Simpson of the Texas state legislature has introduced two bills intended to eliminate the TSA's new intrusive methods of screening at airports. HB 1938 would make it illegal to install or operate a body scanning image with a penalty of up to $1,000 for day day of violation. HB 1937 would introduce the threat of jail time for a non-consensual patdown without probable cause.
The relevant language:
HB 1938:
(b) An airport operator may not allow body imaging scanning equipment to be installed or operated in any airport in this state.
(c) An airport operator commits an offense if the operator fails to comply with Subsection (b).
(d) An airport operator who commits an offense under Subsection (c) is subject to a civil penalty in an amount not to exceed $1,000 for each day of the violation.

HB 1937:
(3) as part of a search performed to grant access to a publicly accessible building or form of transportation, intentionally, knowingly, or recklessly:
(A) searches another person without probable cause to believe the person committed an offense; and
(B) touches the anus, sexual organ, or breasts of the other person, including touching through clothing, or touches the other person in a manner that would be offensive to a reasonable person.
(f) . An offense under Subsection (a)(3) is a state jail felony.
It looks like the state is serious when they say dont mess with Texas.
Bonus: You can read up on how effective these scanners are at catching box cutters or even guns (For those short on time: not very).

Pretty simple: If the Feds say they're gonna do it, the State can't to anything about it (other than take them to court about the constitutionality).

I think Rep. David Simpson is posturing.

This may be true today because most people don't know the truth about state sovereignty, but it's not historically accurate. The states created the Federal govt' and they can get out of the union anytime their citizens decide to do so.

wyoming has a budget surplus. if they told the feds to bugger off, what could the feds do to punish them?

The last I heard, one of the goals of the State of Wyoming was to keep a budget surplus growing in order for all Wyoming kids to be able to go to college for free. Wyoming is a great example of what America SHOULD BE.

The TSA people are Federal employees, they are protected from arrest and prosecution from local authorities if they are following Federal laws. Wyoming may have a budget surplus but they still receive Federal funds for many things such as highways and schools. If they piss of the Feds, the Feds will pull the plug on all the gravy money and the surplus goes by by.

I'm dyslexic, I struggle with letter placement and spelling constantly. Sometimes I can recognize a problem and find a way to correct it, other times something will be written wrong (say a transposed letter or two) and it looks great to me.

So a TSA agent can't be arrested for breaking a state or local law? I find that hard to believe.


The Fed's could take all the funding away, but in return the state could stop sending the IRS tax money from the state's citizens. Then you've got a real constitutional crisis. It's only a real threat to the state if that state is receiving more federal tax dollars than it is paying out.

Federal law takes precidence over state and local laws. I'm not trying to be a dick but you need to study up on how the State, Federal, and local systems are integrated.

Also, the employers, not the State, are responsible for sending income tax dollars to the Feds.

I don't know what all the problems are with what the TSA needs to do. If I need to turn my head and cough to ensure my safety on a flight, I'm all for it.
