Not saying you are wrong, but how do you know that this area stays wet most of the year? The OP stated it does dry out here shortly, and with the rain we had last week, this could just be a easily flooded area. I dont think there is enough info to determine if it is indeed a wetland or not, regardless of who owns it. Just my .02

While I have no problem with banning people from damaging wetlands, the idea that we cannot drive over it until it's decided to put up a massive building in that very spot annoys the hell out of me. Either protect it or don't protect it, none of this BS about protecting it until someone offers enough money to destroy it.

My company just built a plant on protected wetlands. Funny how you offer the city enough money and suddenly it's rezoned. We did have to put in hybrid parking though.

I never said it stays wet most of the year. Infact, if you read that link, it doesn't say a wetland has to stay wet most of the year to be a wetland. Read the descriptions of the major types, mainly "Swamps." I am not saying this is a wet land, but judging by the vegitation growing in the area, it sure as hell makes it look like one.

In the intro it states that a wetland is a place that stays waterlogged or wet most of the year or year long. To me this looks like an area that dries out, but for how long, is the key. Im not an ecologist or biologist but that seems to be the working definition, even they admit in the types that vernal ponds are not necessarly considered wet lands but they are still valuable . Like I said, we need more info.

I'm pretty sure the old guy you menioned is Mr. Briggs. I've known him forever. I even dated his daughter in high school. :) I'm back there a lot getting firewood, playing with my kids, and ocassionally playing around in my Jeep. I often get dirty looks even when I'm on foot from people along the fenceline. I don't think they realize that a private individual actually owns that land. The orange snow fencing is the property line for lots in the unfinished subdivision. I drove through there to get out, true, but that lot will be leveled, backfilled, and have a house on it as soon as the economy starts rolling again.

I even transplanted a 30 foot willow into that area last night,dragging it behind my Jeep. That's how green I am. :)

So, if you know that guy that put the fence up to, I'm assuming, keep people out of there, and he doesn't have issues with driving through there (I admit I'm confused there), and the land owner doesn't care, then I can't see anyone complaining then. I'm not going to submit anything to anyone. It may or not be legal, but if nobody wishes to take legal action, I'm not one to.

I've got some pictures to protect myself, in case someone tries to say it was my Jeep! But I'll take 'em down tonight from the internets. My intention for the pictures was to try to "shake up" the person doing it, if its illegal and they know it, maybe they'll think again before doing it and second to protect myself.

Again, my reason behind this thread was one: who is it? two: do you realize what your doing? three: is it legal?

I cut down a 4' tree and the township is on my ass!!

I actually do live there. :) he had issues before with people dumping back there, and kids that lived on your street partying back there and stuff.The last thing he needs is to be sued by some drunk teenagers parents because a lid fell out of a tree or something. I cleaned up a bunch of garbage last fall. Broken bottles,trash, etc.... We have a huge compost pile in the middle of the area. There is a fairly groomed trail that leads right to the back of my house.
I understand that you had no reason not to think that I was just some jackass who saw some woods to play in while driving down Jefferson.
