Were they on duty? If not, they are legally clear. It's not the decision I would make, but it is their choice. Just because they have the knowledge does not mean they have a legal obligation to act. Now, if they are on duty it is a completely different story and they are legally obligated to act.

BTW, I'm a certified EMT in PA.

And if they do act when they are off duty and something goes wrong, does it open them up to lawsuits?

That is sad, but if they helped her and she would have died anyway, La-a (Eutisha's cousin) would sue them for wrongful death.

I believe EMT don't have to act, just like police doesn't have to intervene if they see someone who needs help or is perpetrating a crime, they can sit and enjoy their doughnuts.

I have determined her cause of death. She slipped and fell on her back. The Tig ol' bitties crushed her chest. EMT's could not have saved her without the help of the Jaws of life or a forklift.

if they werent on duty and did not have there equipment thers not much they could have done more than any one else standing there. And they were dispatchers chances are they had no real world training and wouldnt have been able to do squat any ways

IMHO if they are not on duty they have no obligation to act. That is not necessarily what I would have done, but I wouldn't want to be obligated to work when off clock no matter what the job.

I have to agree. I'm in Emergency EMS as well. They have no legal obligation to act if not on duty. Think about it, with all the lawsuits being filed, I don't blame them. Sure, morally it would tear me up to not act, but if I was off duty with no equipment, there's not much to do. Some agencies even tell their employees not to act off duty, as they are not covered by liability insurance.
