Spend the $5 at small claims first then Hold out till your told to return said items. Most Cops will see you have papers filed and leave it up to the court from then on. Court papers make people pay.

How about calling the tow company and having them tow the go-cart? Let her deal with getting it out of impound.

Might not get your money but I bet you'd feel better.

Craigslist for the go kart. They dont have titles and she probably has no proof that you have it. It has to be worth more than $130 to someone. I doubt she has the money to "sue you" everyone throws that out there, most people never go thru with it. Especially someone thats going to have you hold their sons go kart for a depo. just my .02

Ive been dragged into small claims court a couple of times, I say play it out in front of a Judge. Both times I was sued: First time(was given permission to cut down 2 trees on persons private property, evidently cut down "wrong" trees and Property owner wanted $1700 in restitution) I was cleared because I was given permission and trees were never marked as to which were to be cut. Second: took down deposit of $50. on a $450. snowplow setup. He was to pick up the plow the next day and didn't. Called him up(after a week) to say He needed to get it out of here, at which point he changed his mind and wanted his money back. I refused and sold the plow 3 months later for $400. to someone else. Another month goes by and he shows up in my driveway wanting his $50 back and refuses to leave till he gets his cash. I threatened him(bad idea on my part, doesn't go well with a Judge) and then grabed my cell phone to get the police over here./He left before the police showed up but went down to the court house to file a claim against me. Here was my mistake: upon getting the registered letter in the mail from small claims court, my wife and son hounded me to just give him the $50. back and put it behind me"and I did send the scumbag his cash back" "WELL" he sued me anyways cause he wanted me to pay the $25 filing fee too of which my reply was "F*you. So we ended up in front of a Blondie(Judge Judy) He told his side and I told mine. Judge told me that sending back the $50 was an admission of guilt And didn't want to hear my side of the case. I got in all I had to say anyways and only had to pay 1/2 the $25 filing fee.($12.50) I say let her sue you, and try to claim all the money due you. The Judge is impartial and you dont have to be a licensed mechanic to collect what your owed. "Dress to Impress"
Best to leave the go-cart untouched, but dont give it back till the Judge tells you to do so. She can show up with the police and take it back/maybe, but explain why you have it and you want the Judge to sort it out not her. "Keep your cool with your local police" If shes any kind of a bitch when she shows up with the police that will make you look more credible.(push her buttons while not letting her push yours.
