Default What A Shocker

http://news.yahoo.com/s/ap/20090429/..._pe/crack_laws

Quote:
Federal law now has what lawyers call a "100-to-1" ratio for cocaine sentences, in which a person selling five grams of crack faces the same five-year mandatory minimum sentence as someone selling 500 grams of powder cocaine.
I fail to see the problem here.

Quote:
Critics of the law say it unfairly punishes black offenders, pointing to statistics showing 82 percent of federal crack cocaine convicts were black, while nine percent were white.
Maybe 82% of dealers were black. Again I fail to see where the law is color biased.

I dont care who uses what. Maybe instead of lightening up one one crime we should be harsher on the powder cocaine.

Does that work for you or are you still upset that criminals are being punished?

Did you read the article?????????

Durbin said more than 81 percent of those convicted for crack offenses in 2007 were African-American, although only about 25 percent of crack cocaine users are African Americans

Sounds like the black dealers are a bunch of dumb asses, and just keep getting caught....

or

It's liberal media bullshit, because we all know we have a brotha for president and therefore blacks can do no wrong or take responsibility.....

I agree the punishments should be equal. Why would you suggest lowering one though? If anything make them both death sentences.

I disagree with this completely.

Crack is about 100 times more addictive than powder cocaine. So if you going to punish at all shouldn't crack be punished 100 times harder? (Yeah I made that statistic up). It has nothing to do with race.

I've known several people who have used powder cocaine in their past and are just fine. No addiction, never stole, hold down good jobs and contribute to society. I also knew a guy who used crack. He was addicted until the day he died, stole from his family, hocked everything he owned, stole cars, got arrested several times, and lived a pretty shitty life. Now he's dead. He died at 36 years of age. When he started doing crack it was like a switch flipped. I had absolutely no sympathy for him, he did it to himself.

The point is, cocaine and crack are not the same thing.

On a different note I think they should both be legalized. Let people destroy themselves if they choose to do so. It isn't the governments job to save you from yourself.

Morgan and Zimmer wrote that available data indicated that "...smoking cocaine by itself does not increase markedly the likelihood of dependence.... The claim that cocaine is much more addictive when smoked must be reexamined." They argued that cocaine users who are already prone to abuse are most likely to "move toward a more efficient mode of ingestion" (that is, smoking). Reinarman wrote that the nature of crack addiction depends on the social context in which it is used and the psychological characteristics of users, pointing out that even many heavy crack users go for days or weeks without using the drugs. (Reinarman, Morgan, Zimmer, Crack in America: Demon Drugs and Social Justice, U.C. Berkeley)

Also, the United States Sentencing Commission has recommended that the existing disparity be rectified by reducing sentencing for crack cocaine users.
