The officer let me strap a car out of the ditch so that it didn't cause more rubber neckers to crash. He stopped traffic for all of 90 seconds while I drug the lady back up to the side of the road.
No, prove it.

As an individual you cannot sign away your rights. You can have people sign anything you want, however if you damage their property thay can sue and a waver will not help you, only make it a little harder to start the lawsuit.
That is the reason tow companies have insurance when I worked for a tow company the caller signed wavers but that did not always protect the company

I pulled a buddy out of the back of my road a couple years ago in a shitty 2wd s10. He was being chased by my neighbor down the road for stealing signs, crazy neighbor called the cops but they just called his mom and said to return the signs...funny part is he was going to put the signs in my yard ha ha. Got the last laugh on that one.

i was told by a state trooper that its not illegal to pull someone out but it is illegal to block a road when doing so. i found this out last year when pulling a friend out of the ditch. the cop only stopped to make sure everyone was alright and then he got stuck himself.

Can't find something that isn't there.

Or you would have provided a link to the MCL.

You say a law exists, I couldn't find it. And apparently you can't either.

On edit: we are not talking about freelance pulling for cash. Just a good samaritan look, hook and book.

In the case of the "law," would you not be covered by the good samaritans act?

I can't find it either, I have been doing searches through the MCL for the last hour or so.

I've heard people mention it but never actually seen an MCL for it.

I have been looking also. I called the MSP Richmond post and he said that it is not illegal as long as there is not an accident.

My family owns tow trucks. I have heard (from them) that it is illegal, but I think they wanted the potential $$ from a recovery.

I think if you just use your brain and not be a retard about it its fine. don't accept money, don't pull them out if they hit something or its really obvious that they were doing something wrong, or if they are drunk, etc.

If you find a cop that writes you a ticket for draggin your neighbor down a street when there is a but load of snow, then obviously that cop is a d!ck.

I think that is the only reason people say that it's illegal. To do it for money I am pretty sure you have to have an MSPC # and when you get paid for something you should pay sales tax so NSmist don't for get to send that $2.50 check to the IRS.

The question is not of common sense or what one cop may or may not write you a ticket for. the question is "is it illegal to pull someone out of the ditch?"

Money makes no difference, I am not doing it to make money, but if someone offers it to me as a gesture of good will then thats a different story.

its all about money!

most people with CS (common sense) know how to get someone un-stuck.

Its only Illegal if you get caught, so until we have proof that someone has been issued a ticket for this it doesn't matter.

and demanding money turns it into a service, etc, tips who knows.

If it is, I would never do it again.

If it was illegal someone would have been cited and we would know about it.
And some demented needle-dicked storm trooper would make it his pet peeve to cite for "Reckless Recovery" every chance he got. And not because his sister drives a tow truck, because it is the right thing to do.
