Default 2nd amendment ????

I have a few questions about carrying a weapon without a ccw, not so much that i want to wander around with a loaded gun on my hip, but what are the rules regarding pistol owners in michigan? i know im cool carrying my piece to and from the range and up north to carry as a sidearm whilst doing the hunting, more specifically, i was wondering if for halloween someone wanted to carry as part of a costume (unloaded or with no clip in) would it be legal if the fuzz showed up? its mine and its registered to me so i wanna know my rights

Well according to some people out there it is perfectly legal to carry in MIchigan without a CCW and having your gun showing.


I have no idea how this can be legal. However even if it is you will get harassed by people and someone will for sure call the cops on you. Even if the clip is out and it is unloaded.

bottom line you are asking for trouble even if you are in the right. You also mentioned Halloween party which usually means alcohol. buy and airsoft for your costume if you want to avoid trouble.

x2 its just a lot safer in the legal aspect of it to just avoid the actual firearm being involved in the first place. go to walmart drop $20-$40 on an airsoft. N if you have kids get two and you'll have something to play with, with them.

Just keep safety in mind at all times.

Easy killer ive seen it done before, wanted to know if it was legit if i considered doing the same, i have airsoft guns for costume purposes, no need for the intense reaction

if you're gonna be at a party and drinking, it sounds like you just want to bring a real gun to show how cool you are, and then if questioned, bring up the laws and rights you have to further your coolness.

get a plastic fake gun, get hammered, don't drive, have fun, and don't get arrested.

I don't think it has anything to do with "some people". Unless the township/city/etc has an ordinance against carrying a non-concealed pistol, you can do it. That doesn't mean you won't get harassed or the cops called on you anyway - just like Venator specifically stated. He's in Michigan, so maybe someone can bring him over here so we can beat it to death.

Not so sure about the references he made about the interpretation of the law regarding local municipalities not being allowed to restrict possession. I'd want to see some more credible sources weigh-in on that or see a ruling to carry in my back pocket instead of trying to test it.

And I agree that its an extremely stupid idea to want to do this just for a costume.

And i understand what all are saying it equals bad idea for costme purposes, this is why i seek the wisdom of the omniscent members of GL4X4.

as far as feeling cool and carrying at a party goes, everyone whos going to be in attendance has, either shot it or seen it before and have bigger much more awesome weapons, although i was hoping it would make my penis larger??

i say just get a plastic gun to avoid the (it will cause ) associated with a real gun unloaded or not.

If you want to bring a real gun you should point it at somebody and see what happens, im guessing it wont go over well.

There is no statute that expresses it's illegal to open carry a firearm in the state of Michigan.

It doesn't stop cities from trying to make it illegal. But time an time again any charges have been fought and dropped.

To the OP PLEASE do not drink and carry a firearm in any matter. I personally don't think it's a good idea for you to OC a real firearm as part of a "costume" but this is a free country and you can do what you want.

It is not a matter of whether open carry is legal or not. Open carry is legal.....

HOWEVER, you are then faced with things like brandishing, and creating a public disturbance and other things... and if you are turned away from me then your gun is concealed, and is your shirt hanging over it and all this other bullshit.

you open yourself up to a whole lotta of unnecessary hassle. which as far as I am converned is the last thing a responsible gun owner and carrier wants.

if you want to carry open thats fine, but you will probably get harrassed by cops, you may lose your gun at least temporarily and you will probably spend at least a few hours in jail.

just carry concealed like everyone else... half the power of carrying a gun, is just that it is CONCEALED.

and yeah, as far as for a halloween costume goes? come on dude, seriously. I wonder if people like this should even own guns.

As stated in prior threads i have the gout and i do not drink, so i would have been sober if i was OC, Im not THAT DUMB. As i stated above i have actual toy guns for said costume purposes, it was a dumb idea and you have all made that perfectly clear, I thank you all for your responses,

The thought came to me in ohio so dont blame me i was under the influence of a severe depressant.

The bastard of it is there is no mandatory handbook explaining your rights regarding firearms, you just have to be old enough with a clean record and wala you get a gun? everything ive learned thus far regarding weapons is 2nd hand from people telling me, and some common sense, I thought there would at least be a 10 question quiz or something??? maybe thats a county thing
