Everything except the huge puddle in the last pic looks like anything I would comfortably drive down (and as many of you know, I am extremely cautious as to what I travel down.) It meets my criteria for feeling comfortable; seasonal road sign, numerous tire tracks, relatively decent looking, etc...

Definitely fight it (if you havent already), it isn't just for you, it is for the whole 4wd community. We are losing these roads at an alarming rate.

I came across a couple today up near TC that had signage, and looked like at one time to be maintained, busy roads. Only weird thing was, it was solid grass and you couldn't even see the roadway. You would never know anything was even there if it were not for the signs. At the other end was two barriers on what I assume to be the edge of someones yard, one at the back of their driveway, and one directly back near where the woods started in their back yard. The road ran along the edge of the property and the barriers were made of old washing machines and refridgerators.

This is Olson and Genveva
Is it legal to go straight ahead down the trail??????

This Magruder and Nielson ( at the North end of Magruder)
Notice there is No dead end road sign there.

This is Magruder Rd looking South at a big turn around
There is NO signs here

This at the same big turn around and shows a trail going off to the West
NO sign on that trail either

This is a big water mud hole on the North end of Magruder. This is as far South as we went.

From these picture where is it legal to go and NOT??????

Actually, I just read the rest of the thread, and the whole story, and see why you guys did not fight it. I dont see a problem with splashing through a puddle every once in a while, but stay on the roadway, and dont go back and fourth ripping up the road; that is what the parks are for.

The question is

would you go down the road next time you are in the area after reading the whole thread?????? if not why

and also I heard only one of them was going back and after.

Yeah, I definitely would if I was ever in the area and saw it. I however would not tear it up, and would not try that puddle if it was still there (just because of the pain in the ass it would be if I got stuck.)

I'll check the video tonight but from what we know right now, ANY travel down Magruder Road is just asking for trouble.
Property ownership not withstanding, the DNR, potentually with some local land owners registered complaints, are issuing tickets AND previous tickets appear to have just been paid without contesting the legality of the tickets. So, unless someone want to go for a drive and 'test' the system, I would say that the DNR regards travel down that road as illegal.
I believe GLFWDA is researching this and may have some additional information to add.

i know purple rhino and a few others have gotten tickets out there, basically anyone driving down mcgruder or in that area is getting tickets, stay off cuz their watching. i guess theres a home owner there calling everytime they see a 4 wheel drive go down the road.

I know they plead guilty to the little ticket $100 because the DNR officer also wrote warning tickets for destroying a wet land $27000 and something else. and told them if they even thought about fighting the $100 ticket he would make to 2 warning tickets real tickets and it would cost them big bucks. Is that legal?????

BTT I'd like to know the answer to the above question. I live about 5 miles from Magruder on Neiner and have driven down it multiple times myself and with my dad and other friends. I've never seen a DNR officer out there. I was even stuck overnight out there one time and didn't get a ticket.

1. Who is THEY?
2. DNR Officer can't assess damages. Not qualified.
3. DNR officer can't threaten or coerce defendants into pleading guilty.
4. 'REAL' tickets...what were the ones they got....fake?

DON"T TAKE MY FOLLOWING STATEMENT THE THE WRONG WAY!!!!!

It's comments like the ones above that aren't answered or followed up on that leave users believing that GLFWDA isn't helping defend our right to enjoy public land.
Same goes for the original topic of this thread and the suggestions that QUALIFIED GLFWDA members tried to give some of the new users on this board.
We appear to be damned if we do and damned if we don't.
Without further data and follow up by those who have some knowledge of the facts, we haven't made any progress in understanding this situation any better and we will continue to be in the dark.

P.S. I saw nothing offensive about the Isabella Mudders pt2 video. Everyone did it in 4WD, there was no gross spinning of tires, there was no splashing back and forth, no one hot rodded at the end of the stretch of flooded road. And most of all......no Budweiser can shoved in the lens of the camera at the conclusion!!!!

If anyone needs some legal descrips/plat maps/etc. of that area let me know. My wife does title research in Midland county several times a week and I can have her get what is needed. I also have some relatives in that same business in Midland too. I also have a cousin that is retired from Midland law enforcement I can contact if necessary.

WOW, I missed this statement. GLFWDA was asking that whomever recieved a ticket this particular day to please contact one of us, several names were given, and help us in understanding the situation and the actual MCL# that was violated.

Not one person stepped forward with that information and GLFWDA was without much needed inteligence to make something happen. It does not do any good to ask for help only to be offered it and then not take advantage!

For future reference please contact one of the following GLFWDA members:

Ironman 989 832 7538 ironmanoffroad@charter.net
whiterhino
trailfanatic
Oz97tj

There are many others but let's start with this list, all can be contacted here or with the same screen names at www.glfwda.org

Good update on contacts Pat.
I think we should take Rattler up on this offer to get plat maps and potentially legal descrips. We need to know where we stand on this. It's like cancer.....it will spread.

I was just on the phone with the wife. She will need some more exacting info like where in semi-close proximity you are concerned about on Mcgrudder Rd. Plus what you want to know. What the State owns and whats private? I may go with her tomorrow if she has work in Midland.

Yes, we need property ownership on both sides of McGruder through the questionable area and out both ends. Supposedly the County has a road through there. We also need to County Road Comission road maintenance levels. Pat B nees to chime in hear as he worked with the County more than anyone has.

I already double checked with the CRC when this first came to light.
They no longer posses an easement through that center portion of land.

Best case would be if it's State land on both sides and therefore possibly a State Forest Road.

Let us know what you find, Rattler.
(And Thanks!)

If they abandon it, does it go to the adjacent land owners or revert to the state? Are there any records relative to the abandonment? De we know when it was abandoned?
County should have sign indicating end of their jurisdiction/maintenance.
