What in the hell? Sorry but I don't give a rat's ass what the courts held some 40 years ago, when I enter/use a public restroom I have an expectation that the only noises, odors, and activities will be consistent with one elminating fecal material, or urine, and/or the subsequent cleaning up after same.

Get a room, or a motorhome if you can't resist each other after 'sizing each other up'.

Craig, of Idaho, is asking the Minnesota Court of Appeals to let him withdraw his guilty plea to disorderly conduct stemming from a bathroom sex sting at the Minneapolis airport.

The ACLU filed a brief Tuesday supporting Craig. It cited a Minnesota Supreme Court ruling 38 years ago that found that people who have sex in closed stalls in public restrooms "have a reasonable expectation of privacy."

That means the state cannot prove Craig was inviting an undercover officer to have sex in public, the ACLU wrote.

The Republican senator was arrested June 11 by an undercover officer who said Craig tapped his feet and swiped his hand under a stall divider in a way that signaled he wanted sex. Craig has denied that, saying his actions were misconstrued.

The ACLU argued that even if Craig was inviting the officer to have sex, his actions wouldn't be illegal.

"The government cannot prove beyond a reasonable doubt that Senator Craig was inviting the undercover officer to engage in anything other than sexual intimacy that would not have called attention to itself in a closed stall in the public restroom," the ACLU wrote in its brief.

The ACLU also noted that Craig was originally charged with interference with privacy, which it said was an admission by the state that people in the bathroom stall expect privacy.

Craig at one point said he would resign but now says he will finish his term, which ends in January 2009.

I don't know about the original court ruling - but given that it was "38 years ago" according to the article, I'm thinking that such a thing wasn't quite as popular. It also specifically states "stall" and specifically is written regarding the Larry Craig case...

In this case, I think it's safe to say that the police were attempting to enforce laws that are inspired to protect the majority of folks that do not want to be assailed or subjected to lewd behaviour - to me a reasonable expectation.

I personally don't care if someone wants to blow someone else, just do so some place a lot more private than a rest room stall. Hell, the back seat of a windows tinted minivan, or suburban even, but if you can't control yourself to such a degree that you have to get yourself off, or poked so badly that you have to do it in such a place as an airport/public restroom, that should just fall under that 'common sense' clause that we unfortunately can't legislate.

This law could apply to the mile high club. I think I just confirmed it for myself. It is a good law. Don't F with it.

I wouldn't want the job of the undercover. Just sitting around a bathroom stall waiting for someone to hit on you. What a fag!

My German friend met a girl at a birthday party; the party moved to a bar. Everyone that came from the birthday party was drunk. The girl started dancing with my friend. She grabbed him and dragged him to the female bathroom. They went into one of the stalls and started going at it. They were both inebriated and preoccupied to notice that they had broken the stall wall during their vigorous action and people could see them. A small crowd began to form to watch!
