Close but not completely right. It isn't the bid that binds. It is the combination of the high bid and the "fall of the hammer". Unless stated otherwise, all auctions under UCC law are presumed to be "with reserve". Regardless of what Ebay says, legally, you can pull your item up until the last minute, unless you have stated a reserve that has been met. Ebay's user agreement goes against this, but who cares. The UCC rules, eBay doesn't. So, in this case, the hammer fell, there was no stated reserve, the bidder made an honest bid, and the seller legally has to deliver for face the financial penalties for not meeting the agreement. But, it is up to the buyer to force performance on the part of the seller. That means hiring a lawyer, probably in the state where the buyer resides to pursue the legal action. Is it worth it? Depends on how good of a deal you got.

It's a fake seller and there isn't even a car for sale. They post it in the wrong area/category on purpose so ebay doesn't notice. If too many people bid on it then it gets too much notice by everybody. if you pay for it, pay only cash in person. If they want it any other way it's a scam.

RONG! You cops are all rong on this site. You can pay thru PayPal and if the item doesnt show up you get your $ refunded. The seller has to prove the item was sent / delivered or the purchaser is covered.

Here is a link to the auction http://www.ebay.com/itm/250880788393...84.m1423.l2649
It was a 95 Mustang convt. I decided to not pursue it any further, it just didnt seem right to take advantage of someone like that. It would have been cool to say I got it for $1500, but I really have no need for it anyway.

They already cancelled the transaction and made a big deal out of it, but I guess it was worth a shot.
