My mom teaches michigan real estate law and is a broker. I just asked her about this. The limit is 6 years that you can go back and recover damages. But you have act in a timely manor as soon as you find out the problem.

She said also that you can claim the damages in the form of your added heating costs. Get 2 estimates for a new furnace.

Also, if the estate has been dissolved, the executor of the estate is still personally liable for statements made on the paperwork for the sale of the house. Small claims limit is 5,000.

Well, talked to the HVAC guy today and he changed his mind about giving me the copy of the signed receipt saying the furnace is bad. He has to protect his companies liabilities... I get that. So, basically I'm screwed. With out the proof it's a hearsay case, and I don't have the time or money to hire a lawyer to fight her on it. The other side is if I win, chances of getting the money is slim (can't get water from a rock) plus I'd have to deal with the seller again, which was a nightmare then (when I was giving her thousands of dollars) I can't imagine what it would be like if I was making her pay me thousands of dollars. I'm pretty sure she is Bi-polar, and I can't have her causing problems for my wife and child when I'm at work, so I'll suck it up, chalk it to a life lesson. :sigh:

You could have an attorney subpoena him or the paperwork most likely.

Personally I'd chase that shit down simply out of principle.

I would. There are plenty of things I now know to look for if I decide to go house shopping ever again. Things that were never on my radar before even though I spent two summers building houses.

I should have asked why the basement in my 40 year old house was brand new... 6 moths later I found out why.

My mother was in Real estate.
I had a co- worker she had shown houses to for almost a year.
I had teased my co-worker for months that I'd pick a house.;).Co- worker wanted to see a house 1 1/2 hours away from us. Not my mothers listing. I rode with my mom because it would have her out late un known area. I sat in the car. Guy living in house came up and started talking to me about if he'd have kept the house what he would have done.
One thing was a New well.
I told my mom, she contacted listing agent
Who assured her that the man was trying to blow the sale of the house because ex-wife was getting profit.
Friend chose that house, paid for a home inspection, bank also inspected. Bought house,
About 2 months living in house in winter well went out.
Both inspectors swore that well preformed to standards when tested. Even my statement was hearsay because husband was not seller. He wouldn't comment. No recourse.
Last summer my sister bought a house, house sold as is but county has standard that must be met. Well and septic inspected by health dept.
Passed. My mother and my sisters father- in - law were waiting on moving van. My mom walked over and said were is the septic. Health dept had a flag up,Per county records were tank was suppose to be. There was not a septic tank anywhere on property. Just a tile field that was junk. Called health Dept. Worker said I took a metal rod and I thought there was one there, right were records say it is.
My sister had to get a complete septic installed and inspected. As is, no recourse.

I may look into one of those free consultation deals, but I'm not hanging my hat on it. I figure I wiser to just buy a new furnace myself and take care of my family. If I can find a way to get reimbursed, sweet. If not, damn.

Good luck with this. From the sounds of it a small claims judge might rule in your favor but you may never see the money. By the time you get an attorney involved you may have close to the cost of a furnace.

Good luck. Hopefully it works out for you. I had a few small issues when I bought my house, but nothing that major. I did what you are likely going to do, and just ate the cost of repairs to avoid dealing with the sellers again. I only had a couple hundred dollars in repairs, but if my repairs were close to 3k I may have taken a different approach though.

Michigan small claims courts have changed, you can now request the judge to garnish wages/assetts/income taxes if the other party does not pay up.

You still may never see anything, but it's an option.

With small claims you can go the route of a lawyer, or you can take the time to do the research (like you did with the heavy towing permits) and fill out all of the necessary forms and paperwork yourself (including requesting a copy of the recipet from the hvac company thourgh the courts)
