They can't go forward without the township approval. It's part of the state grant process that it gets the blessing of the local units of government.

You quoted my response to the legality of making a decision immediately following a public hearing, which is correct.

Assuming you are responding to my earlier post that I didn't see a conflict:

I missed the part that he didn't disclose that he lived right across the street. That does change things. He certainly should have done that, and asked the Board members if they felt he had a conflict. They are the ones who would determine if he does or does not have a conflict.

I don't really buy the argument of raising his property value (I would argue that he made a decision which eliminated a potential threat of lower property value). On further thought, though, I do agree that he seemed to be making his own argument that he had a conflict of interest by expressing a financial burden of lower property values. If they would have never said a thing about lower property values and just said they were concerned about noise, dust, vibration, traffic, etc he would clearly not have a conflict.

Hmm.

In the end would the decision have changed if he abstained? Probably not. Even if you brought this to court, the judge would probably just invalidate the decision, at which time the board would hold another meeting, and he would recuse himself and the decision would be the same, many months and lots of $$$ later.

Another underlying thing is that it sounds like this was more of an information/public feedback meeting, rather than the board giving a formal approval or denial. I say this because it sounds like Oakland Parks could still go ahead and do it if they want to. In that respect it wasn't even really a motion that meant anything other than to express displeasure.

I didn't read this whole thread but in my eyes the people in that meeting were all adjacent to the property, although oxford is small, they are not the voice of the actual township. In my count there were 10 people that weren't adjacent to the property and only 5 were against it.

I live on a main road that feeds directly into Oxford, i did not see one ounce of increased traffic last weekend and according to that one broad, there were over a 100 out of town horses here last weekend.

the only issue I see with this is then the entire park would have to be engineered, Detroit is all flat. Also I believe there are legal issues that using a quarry is slightly easier. I forget the specifics, but this came up when they were trying to close the Mounds back in the late 90's. Some of the reasons the locals where giving where tossed out due to laws about use of quarries...

other then that, I'd wheel there.
