Spare tire size smaller than tires

Sorry if this is a dumb question but I would rather ask a dumb question than ruin an axle. I have a 2000 TJ with a D44 tru trac rear and D30 front. My 33" spare on an offset wheel is destroying my tailgate. Can I safely use a 30" on factory wheel as a spare? Will a smaller spare cause me major issues if I had to use it?

You should be fine since it isn't locked. Worst comes to worst, put one of the regular size wheels form the front in the back, then put the 30 on the front...
