One of my co-workers just went thru this, they paid him for some of the extras. That will all depend on your Ins Co and policy. I had him ask about buying it back and decided it wasn't worth what they were asking.

After looking over pictures I have proof that there middle vehicle driver lied to the cop about what happend!!!

This shall be interesting in court.

I tried telling the cop what happend but he didn't want to listen at all to my end because I was the third vehicle back. He literally put his hand up and walked away to his air conditioned car.

He's forshure getting a complaint put in towards him!!!

Every cop I have ever met has the "talk to the hand" attitude. FTP! Totally bring up what the officer did to you in court!

It was a state cop that showed 2 hrs after the call, I'm guessin its possible he don't even show for court. But I won't know till that day.

and for those that think its not totalled, i had it towed to the body shop and they said they can gurantee its totalled and are suprised i didnt get a scratch or anything not even from the airbags blowing, soo I towed it to my house the next day and the insurance rep will be coming here to inspect it. If they think they can fix it more power to them, but I really doubt it.

You don't buy it back after the claim. The insurance will set what its worth as a wreck, let you keep it an send you the difference in a check. The appraiser will come buy, tell you what the verdict is the. You have x days to make a decision, anything you want to take after the appraisal you can take, so long as its not nailed down from what I understand.

bought my girlfriend's XJ "totaled"
1997 175k 4.0 XJ country wasn't perfect, rockers are starting to rust, ect. my cousin owned it, she was at a party and somebody backed out of the driveway at night and hit it, bent the bumper up, dented the drivers fender, pushed the bumper brackets into the stamped frame rails. we paid $800 for it. insurance company paid my cousin $3700 before buyback.

I put a fender on it, a header panel, and it got the front bumper off my jeep. we've got less than $1000 into it. fender matches perfect and the headerpanel is really close.

Eat the ticket don't even waste time in court. You need to look at this like a layer would.
Were you going above the speed limit before the accident?
Has the vehicle been modified in any way that would affect it's stopping distance?
How long have you been awake before the accident?
The list goes on.


Basically if you had enough stopping distance you would not have hit them. It does not matter what the people in front of you do. You need to constantly think about if that car suddenly stops if you will I be able to without incident.

People blow tires, hit walls, side swipe each other, loose stuff from trailers, cross the median/center line, fall asleep and so on. With very few exceptions if you rear end someone your at fault.
I drive a truck where if there is anything that could have been done to avoid the idiot hitting me I am at fault despite what the idiot may do. Even if I establish I was doing everything to avoid the damage they will go back checking records, times, speeds, road conditions, and so on looking for a reason to say "if you were not here this would not have happened and there for you are at fault".

The only way you can get out of a rear end collision is what I stated above. If the driver you hit was uninsured you can claim that "they are at fault despite what you may have done due to them not on the road legally. If they were not on the road you would not have hit them". You will need to prove without a doubt that if they were not on the road no damage would have occurred.

Look at it this way, you were smart enough to put full coverage on it before the incident, you are getting a ticket but things could have been worse, no one is claiming injuries or suing you(yet), you can find a tj easily or upgrade to a jk getting better mileage.

Your coming off as a crybaby whining about how the cop treated you and what the car in the middle said. Stuff happens your not perfect, fess up you messed up, pay the ticket, and hop in a new ride.

Also do not expect that insurance companies will not check into online forums like this to see what you are up to. I know of other cars that the adjusters have shown up with copies of every post you have made. If you talk about wrecking your jeep off road then make a claim about it on road, they may find out. It is the adjusters job to get claims closed for the least amount of $

Yes you SHOULDbe able to buy it back unless they feel like being hard asses. I work at a body shop and when my 03 2500 hd was totaled they asked me if I was intested in keeping it since they knew I worked on them for a living. The truck was about 7years old with 72,xxx miles on it and I payed (they deducted off the settlement) $1500 to keep it. I put $200 in it to make it drivable and drove it till just a few months ago that way at which point I fixed it properly lol.

So if you really wanna keep it, then when the call you up and tell you it's totaled let them know that you are interested in keeping it and they should give you a price after which you can decide if it's worth what they want.

To Freak be carefull what you do and tell people because once they appraise the vehicle if you take anything off it then they can nail you for insurance fraud. If you wanna take stuff off then it needs to be done before the appraiser looks at it.
