Because private citizens and businesses aren't protected by Govt Tort Liability, they CAN be sued for allowing (or failing to "aggressively enough" try to prevent) stupidity on their property.

Ummmm.... Yeah.... Thus the part where I said "If the rangers let him act that way and someone gets hurt, the park is responsible".

Nope. :jeopardybuzzer:

The areas where the state allows people to sue are very specific (roads in disrepair, sewer backups, traffic accidents with state vehicles, and a couple other more narrow ones I don't recall from memory) where the state can be show to be negligent. Actions in an ORV park or trail aren't among those allowed.

Government <> Private Citizens/Organizations

Rules enforcement is to prevent the place from becoming the wild west.

Interesting, because when my buddy got hit while walking trails by a retard on a quad, he couldn't sue the retard for some reason or another and was told he had to sue the park/state for damages, but he didn't want to sue the park so he ate the cost other than what his insurance paid

Wow.

He COULD sue individual operating quad in a negligent manner, but not the State (assuming the "park" was a state park/forest/trail). If it was federal land (NFS trails) he would likewise be SOL as to suing the government.

Sounds like he got some fawesome legal advice. Hope it was free, because then he would've gotten his money's worth.

Wouldn't be the first time, lol. Either way I do apologize if my apparent misinformation misinformed someone. Either way, as slow and cautious as I am offroad, I have no need to worry.

I thought it was a state park, up by college in Marquette.

Well since I've personally seen him blasting around the park at idiotic speeds, launching the shit out of his truck, and cutting off countless people, all in high traffic 2 way areas with blind hills on one of the busiest weekends of the year, I'm gonna have to call BS on that one. He would've hit me personally had I not been on the lookout for jackasses like him.

I can respect you trying to stick up for your buddy, but having a lot of money and a lot of cool trucks doesn't make him smart or courteous. I've never met the guy, maybe he and I would be great friends, but I can say without a doubt that he drives like an idiot and is the type of person who will eventually get that place shut down. Another one of the dickbags who thinks whoever has the most money wrapped up into their rig has right of way.

I guess this thread got a little attention. The jump was crazy, a little out of control, but cool to watch. There was a group of spotters so there was no chance of anybody else getting hit. I like to jump as much or more than anybody else, but always have a spotter when i do.
Concerning the guys saying they almost got hit while hanging out on the backside of a hill, DO NOT bhang on the backside of any hill. Only bad things can happen.

Jumping is cool, I've done it, I've watched it, I've fixed rigs after going too high, and I don't have a problem with it if done correctly. Problem is, this guy runs around jumping EVERYWHERE, not just big hills with spotters. Example: I repeatedly saw him getting 3+ft of air on the high traffic 2 way "road" between the main 1 way section and the drag strip during one of the big weekends(can't remember if it was Labor Day or Memorial Day). As far as I can tell he's reckless and loves attention; 2 things that make for a very dangerous combination.

Nobody this guy almost hit said they were hanging out on the back of a hill. I know I wasn't, that's as dumb as jumping in high traffic areas.

I agree, idiots everywhere on those weekends. It wasn't a surprise, just proof that this guy is not as careful as his buddy claims.

I wasnt hanging out on the backside, my quad just does not have the capability to go 1000mph. I was just rolling through them in 3rd gear and a group of those guys came flying over and landed about 5 ft from me.
