the issue is, that there won't be many willing land owners in most residential areas. and some communities are going to fight tooth and nail the notion that their zoning is null and void... West Bloomfield is one such community that isn't afraid to take on the big gas companies. I imagine orchard lake village, and bloomfield twp will follow suit.

Unless a large piece of land is owned, it really doesn't matter what an individual says. These deposits cover large areas. The oil companies are trying to do the legal thing, but the reality is if a neighbor allow it then the oil will be sucked off from the whole deposit. It would then be up to the landowner to prove that some of the oil did come from their land. Good luck with that.

The 1/8th is divided up between the pool. If you own 10 acres in a 100 acre pool, you get 1/10 of the 1/8th.
If she owns the mineral rights, and doesn't sign the lease, she could become an investor, pay for her part of the well, and collect her share. Get a lawler that deals with oil and gas leases.
