Default Selling a boat in MI

I am trying to sell my 16' Grumman fishing boat (35hp outboard).

It does have oars in it, and the DMV says that boats need a title if they don't have a 'permanently affixed motor'. Any clarification on what that means?

The reason I ask is because i don't know that I have a title. I was planning on signing over the registration and providing a bill of sale. Will this be sufficient?

Also, do the new permanent trailer plates go with the trailer? Or does the new owner have to re-register that as well? as in, get a new one? There is a line to transfer ownership on that as well I believe.

Never sold a boat, and want to make sure I don't screw it up.

You won't have a title just a registration. That isn't even necessary. Just a bill of sale with something that identifies the boat like MC numbers or HIN numbers.

Trailer plates stay with you, and in my experience you have to say you sold the trailer with the boat otherwise the buyer won't be able to register that.

I think you need a title for the trailer.

Or get it weighed and get a title based on that.

I've always just been able to use the registration, but I think your right as long as it has the weight on it you should be good.

Never give a buyer plates (maybe a friend to drive it home and bring the plates back). With a vehicle or trailer . That is your name on the plate . Also if you keep the plate you can transfer it . To a new if , it is the right plate . (does MI still do , car plate only . truck plate only?)

Trailer plates are not transferable, but that doesn't stop 99.99999999999999999% of trailer owners from just sticking the plate on another trailer.

You've got it backwards. It has a title if it has a permanently affixed motor.

yea, mistyped. I didn't know if OB motor considered a 'permanently affixed' motor, since it can be removed and it's basically a rowboat

Might help if you are giving advice to know what you are talking about.

My boat has a title, trailer does not. You are supposed to sign over the registration for the trailer which is supposed to invalidate the plate but most people do not.

Is it a tiller motor?

If it is just a small tiller outboard it is not permanently affixed to the boat and you shouldn't need a title.

If it has a steering wheel and a controls box with a throttle you probably need a title.

The only time a boat ever has a title is if you buy it with a loan. ( so their can be lien ) But if a boat ever has a title it will always have it.

Last edited by Derek B; January 9th, 2012 at 08:12 AM. Reason: lien was wrong

Mine has a title, no lean at this time. It's blue. The title I mean. Might have had a lean at some point it it's life.

The law is clear on this issue, the plates are non transferable in any case. You must destroy your plate and the new owner gets a new one.
