I think Rep. David Simpson is posturing.
Texas hasn't paid federal TAX to the government since Obama took office..

I've got friends down that way. There's been alot of talk there that IF Obama wins in 2012 they will be voting in TX to leave the Union..

Any documentation that says the citizens of Texas don't pay income tax? Otherwise I say you're full of steer poop.

I don't think you're being a dick, it's just a friendly debate, but I'm well aware of the constitution and how it reads.

Federal law only trumps state law when it comes to the 18 powers enumerated to the federal government listed in the constitution in article I section 8. All other powers are reserved to the states or to the people.
(See article I section 8, and Amendment X of the US constitution.)

Do you think a state couldn't pass a law that forced business within that state to send all federal tax dollars to the state to be escrowed in a fund and withheld from the federal government until such time as the Federal government stopped withholding federal funding? I'm not saying it's the best solution or even a constitutional solution, and I wouldn't say it will ever happen. Then again I wouldn't say it is impossible either. Other things would probably happen first, like sucession.

As far as the civil war settling the ability of states to suceed, well I don't believe that it is settled.

Here's a good read that just came out today that agrees with me, see what you think....

I skimmed the article because I don't have time to invest at this point to enter an intellegent rebuttle. On the surface it does not look like a credible source of information due to the sensationalism and the goofy ads in the article. I'm working 12s over the next few days and I have school at night so my time is limited. If I find the time over the next few days I will try to put together a counterpoint.

Lewrockwell.com is not a "mainstream media" site but it is very credible.

Never heard of Lew Rockwell? Then I invite you to learn all about him. I'll use wiki so no one has to question the credibility of the site.....

Lew_Rockwell Lew_Rockwell

and the Ludwig von Mises Institute...

Ludwig_von_Mises_Institute Ludwig_von_Mises_Institute

and of course the Austrian School of Econimics....

Austrian_School Austrian_School

The author of the above linked article...

Butler Shaffer teaches at the Southwestern University School of Law. He is the author of the newly-released In Restraint of Trade: The Business Campaign Against Competition, 19181938 and of Calculated Chaos: Institutional Threats to Peace and Human Survival. His latest book is Boundaries of Order.

I hope you find the time, it will be worth the effort.
