Default My buddy got an MIP...

He got an MIP 10 minutes before his 21st birthday. He's really stressing about it and was wondering what he should expect. I said depending on the judge it's going to be dismissed most likely, but he really wants to know. The actual ticket was written at 23:50 so, what do you all think?

Worse that can happen is some probation and some fines, right? He's never got in trouble before and I think they'll just void it.

my buddy got an MIP 23 hours before his 21st, and iirc it wasn't a big deal at the time. It did affect him when get got pulled over a year later and blew .09.

All depends upon the jurisdiction the ticket was wrote in...

My buddy got an MIP 1 day before his 21st for having a closed case of beer in the trunk of his car, and he's never been in any kind of trouble at all prior to this - they gave him probation, fines, and an alcohol assessment class.....and he didn't even have alcohol in him (total bullshit IMO).

So, given that other people have gotten a lot less, I'd say jurisdiction is going to be the deciding factor.....

I'll agree on the jurisdiction. My sister got one in Lansing and it was the night in jail, hefty fine, community service, alcohol awareness class. The full nine. At least she got to throw up on the cop though.

I got my 2nd MIP 10 days before my 21st.

If it is his first its really not something that should end up being a big deal. Probably a Fine and Probation.

On my 2nd I got one year probation stay clean and they wiped it off my record. But in Michigan at the time if you got a second they did take your driver's license away for 30 or 90 days, I can't remember.

I had 3 of them and on the 3rd I had to take a youth alcohol rehabilitation class.

I was never given probation...just fines.

There were some hot, alcoholic chicks in there though, it wasn't so bad.

What did he do to get pulled over? I imagine they had to have a pretty good reason to pull him over and do a search. Don't they have to have reason and/or permission for a search and seizure?

Actually, he was pulled over because his licence plate was covered with snow....that is "why" he got pulled over (he was in a college town that has three police forces and it was 2 A.M. on a friday night).

Cop the searched his car because he had a knife on him, which he told him he did, found the beer, gave him a sobriety test (which he passed), handcuffed and put him in the back of the car, wrote an MIP, sent him on his way.

He fought it, and the judge was a cock monger too - only made it so the MIP wouldn't show up on his record.....Yes, given the circumstances he was technically a minor in possession, but I think the punishment was a little overboard considering it was literally 1 day prior to his 21st and he was totally cooperative with the officer

Again, I think the whole deciding factor is jurisdiction....

When searching a vehicle, the person is handcuffed, and placed in the cruiser. Standard operating procedure.

Remember these words "No Officer, I do not consent to any searches"
Thats all you have to say, unless you are an idiot, and give the officer a reason to search the vehicle.

Didn't know that was standard operating procedure - point taken.

However, the cop supposedly told my buddy "I see you have a knife in your vehicle, which gives me probable cause. Mind if I search?" The knife, a craftsman stanley type IIRC, was sitting in the cup holder of his center console.

Agreed that my buddy allowed it, and for this was a moron (though in his defense he's never been in trouble with the law and claims he didn't know you could say no), but if he said probable cause doesn't that mean he could have searched irregardless?

Officers are allowed to lie about certain things to get into a home/ perform a search. (although they cannot falsely claim that their is a warrant.)
Individuals do not need to be informed of their right to refuse a search.

Again, I understand that....If it were me, I would have said yes.

Is it my buddy's fault?? Yes, and for that he is a moron. Did the system really need to spend our tax dollars and tie up time for more important court uses, especially since he would be "legal" in a day?? IMO, no. But, they did, and that is what I was trying to get across with my post - that the outcome of an MIP all depends on jurisdiction....some people get off easy, others don't.
