I had a similar issue with my e40d. I changed the tps and it fixed the problem. I also had another e40d with same thing and it was the MLPS on the shift arm.. Do not mess with drooping the pan until you change both o these first!!
I replaced my trans and the new one had the same problem.. Come to find out it was my EEC. I replaced it and good to go.
If I were you 100% start with the tps.. Then the MLPS
