I can see where the biochemical oxygen demand (BOD) would be off the charts should a spill reach a waterway. The effects of a large milk spill would be short term compared to petroleum so I don't know why the State is making such a comparison.

I would say a good compromise would be to do a site study to see if there are any potential water contamination issues (drainage ditch, creek, river, wells, etc.). If there are then a spill contingency program should be developed.
